1. Scope
These General Terms and Conditions apply to all orders, deliveries and services via the online shop www.luckytohaveit.com between Luckytosh GmbH (“Seller”) and its customers (“Customer”).
They apply to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB), unless expressly stated otherwise.
2. Contracting Party
The purchase contract is concluded with:

3. Offer and Conclusion of Contract
Product presentations in the online shop do not constitute a legally binding offer, but an invitation to place an order.
By clicking “Buy now”, you submit a binding offer to purchase the products in your cart.
The contract is concluded upon receipt of the order confirmation by email.
The contract language is German.
English translations are provided for convenience only and have no legal effect.
The contract text is not stored permanently; order details are sent via email.
4. Prices and Shipping Costs
All prices include statutory VAT.
The applicable VAT for the destination country is calculated automatically at checkout.
Shipping costs are shown during checkout. More information is available on shipping costs.
Worldwide shipping from Germany, except Switzerland and Liechtenstein.
Orders from Switzerland and Liechtenstein are shipped from Switzerland.
5. Payment
Secure payment methods displayed during checkout are available.
Payment processing is handled via our payment service providers.
The respective terms and privacy policies of the selected payment provider apply in addition.
The purchase price is due immediately upon conclusion of the contract.
Set-off is permitted only with undisputed or legally established counterclaims.
6. Delivery
Shipping information is provided by email.
Within Germany: Deutsche Post.
Internationally: DHL.
Estimated delivery times:
Germany: approx. 1–3 business days
EU: approx. 2–4 business days
Outside the EU: approx. 3–6 business days
Orders up to 11 units per color/type are shipped as letter mail and fit directly into your mailbox.
Larger orders are shipped as parcels.
Invoices and delivery notes are sent exclusively by email.
7. Retention of Title
Goods remain the property of Luckytosh GmbH until full payment is received.
8. Discount Codes and Price Reductions
LUCKY TO HAVE® grants price reductions exclusively through explicitly communicated and valid discount codes. Only discount codes provided directly by LUCKY TO HAVE® or individually issued to customers are valid.
Publicly shared, unauthorized, or expired discount codes do not entitle the holder to a price reduction. Cash payment or retroactive application is excluded.
9. Right of Withdrawal and Returns
For consumers (private customers):
Our products are small household tools intended for direct handling.
For hygiene and economic reasons, there is no right of withdrawal or return for orders up to 33 units per color/type.
Used or opened products are excluded from exchange.
For orders of 33 units or more per color/type (factory-sealed sales units), the statutory right of withdrawal applies pursuant to §§ 312g, 355 BGB.
Return shipping costs are borne by the buyer.
In case of incorrect delivery or damage, contact info@luckytohaveit.com. We will handle replacements quickly and straightforwardly.
For business customers (retailers/resellers):
No right of withdrawal applies to entrepreneurs (§ 14 BGB).
Warranty claims for entrepreneurs are limited to 12 months from receipt of goods.
10. Warranty and Complaints
Consumers have statutory warranty rights of 24 months from delivery.
In the event of defects, you may choose repair or replacement.
If remediation fails, price reduction or withdrawal is possible.
Please inspect goods immediately upon receipt. Obvious defects must be reported within 14 days of delivery.

11. Liability
Liability is governed by statutory provisions.
Liability for slight negligence is excluded unless essential contractual obligations are breached.
Liability for consequential damages or loss of profit is excluded.
Product Safety & Liability Notice

Not a Toy: This product is a functional tool, not a toy. It is not intended for children.

Parental Responsibility: Parents or legal guardians are solely responsible for the conduct and safety of their children. Direct supervision is required if handled near minors.

Assumption of Risk: Use of this tool is at your own risk.

Limitation of Liability: The manufacturer assumes no liability for damages or injuries resulting from improper use, neglect, or unauthorized handling.
Recommendation: wash Lucky instead of disposing.
If disposed of: plastic waste.

12. Intellectual Property and Design Protection
All content, designs, images, logos, product forms and packaging related to LUCKY TO HAVE® and LUCKYTOSH® are protected by copyright, trademark or design law.
This includes registered word marks, figurative marks and registered designs.
Rights are owned by the Swiss trademark holder and licensed to Luckytosh GmbH.
Unauthorized use, reproduction or imitation is prohibited and may be prosecuted.

13. Use of POS Materials and Brand Representation
Offline sales (retail, trade fairs, face-to-face sales) are permitted.
All sales-support materials (POS materials) featuring Lucky logos, protected brand elements or product photos must be official materials provided by Luckytosh GmbH.
Independent creation or use of unauthorized POS materials requires prior written approval from the Lucky design team.

We value long-term partnerships and coordinated brand presence.
All visual and content representations may require prior approval to ensure consistent global branding.
14. Regulation of Online Sales
Online distribution of Lucky products by third parties is strictly prohibited.
This includes all forms of e-commerce, online shops, marketplaces, social commerce and similar systems, nationally and internationally.
www.luckytohaveit.com – is the sole official online shop worldwide.
Only licensed partners with explicit written online distribution licenses may sell online in approved regions.
Licenses are granted individually, reviewed regularly and revoked immediately in case of violations.
Violations will be legally pursued.

15. Data Protection

16. Jurisdiction and Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction, where legally permissible: Konstanz, Germany.
Notwithstanding the above, the following applies:
As the licensee, Luckytosh GmbH hereby points out that for licensing relationships as well as for all disputes arising from or in connection with intellectual property rights – in particular trademark, design, copyright, licensing, and branding rights of LUCKY TO HAVE® – the place of jurisdiction is Bern, Switzerland.
17. Final Provisions
If any provision is invalid, the remaining provisions remain effective.
Statutory provisions replace invalid clauses.
